1. The [Special Offer] CHEER-FOOD STREET FESTIVAL - Total face value of HK$100 Fashion Walk e-Dining Coupons ( the “HK$50 Fashion Walk e-Dining Coupon(s)”) are issued under the “hello Hang Lung Malls Rewards Program (hello恒隆商場獎賞計劃)” (the “hello Program”), an integrated membership program managed and operated by Hang Lung Real Estate Agency Limited (“HLREAL”) (by itself and for and on behalf of Hang Lung Properties Limited) and which can be used at the e-Dining Coupon Participating Merchants (as defined below) located at Fashion Walk which is situated at Paterson, Food Street and Kingston Street, Causeway Bay, Hong Kong. 2. The terms and conditions (the “hello Program T&C”) of the hello Program which can be accessed via the “Hang Lung Malls App (恒隆商場手機應用程式)” (the “Hang Lung Malls App”) or at www.hanglungmalls.com/en/tnc apply to the HK$50 Fashion Walk e-Dining Coupons, save that in the event of any discrepancy or inconsistency between (i) the hello Program T&C; and (ii) these Terms and Conditions, (ii) shall prevail. 3. Unless otherwise defined, capitalized terms used herein shall have the same meanings as those defined in the hello Program T&C. 4. Each HK$50 Fashion Walk e-Dining Coupon entitles the holder to spend up to an amount as specified in the Hang Lung Malls App and is valid for conducting dine-in transactions only at designated merchants (the “e-Dining Coupon Participating Merchant(s)”) located at Fashion Walk. HK$50 Fashion Walk e-Dining Coupons cannot be used to settle any service charge, tips and the like in connection with the dine-in transaction. A list of the e-Dining Coupon Participating Merchants are displayed in the website of Fashion Walk at www.hanglungmalls.com and the Hang Lung Malls App. The list of the e-Dining Coupon Participating Merchants may be subject to change from time to time at HLREAL’s sole and absolute discretion. In case of any dispute, HLREAL reserves the absolute right to make the final decision and the decision of HLREAL shall be final and conclusive. 5. No minimum spending is required for using a HK$50 Fashion Walk e-Dining Coupon. A maximum of ten (10) HK$50 Fashion Walk e-Dining Coupons can be used for each single transaction. In the event the transaction amount of a transaction is more than the value of the HK$50 Fashion Walk e-Dining Coupon(s) used, the difference must be settled by the Member. In the event the transaction amount of a transaction is less than the value of the HK$50 Fashion Walk e-Dining Coupon(s) used, any unused / unclaimed balance / benefits will be forfeited and cannot be carried forward. 6. The HK$50 Fashion Walk e-Dining Coupons cannot be used in conjunction with any other coupons, certificates, vouchers, cash dollars and the like (electronic or otherwise and whether or not issued by HLREAL and/or its associated companies), except for the Hang Lung e-Shopping Coupons and hello dollar. 7. This HK$50 Fashion Walk e-Dining Coupon is valid for 14 days upon the date of issuance and will not be reissued if expired. Upon expiry, any unused balance / benefits will be forfeited and cannot be carried forward. 8. Only HK$50 Fashion Walk e-Dining Coupon(s) from the same hello member (the “Member(s)”) account can be used in a single transaction. 9. Each HK$50 Fashion Walk e-Dining Coupon can only be used once at an e-Dining Coupon Participating Merchant. 10. A maximum of ten (10) e-Coupons can be used for each transaction. 11. Only the Member to whom a HK$50 Fashion Walk e-Dining Coupon is issued may use such HK$50 Fashion Walk e-Dining Coupon. 12. HK$50 Fashion Walk e-Dining Coupons cannot be varied, returned, replaced, cancelled, transferred, resold, refunded or exchanged for cash or discount or other products. 13. Unless the goods and/or services to be purchased with the HK$50 Fashion Walk e-Dining Coupons are expressly and specifically stated to be supplied / provided / manufactured by HLREAL, such goods and/or services are not supplied / provided / manufactured by HLREAL. HLREAL does not in any way warrant the quality and condition of or any other matters in connection with such goods and/or services and shall not be held liable for the same. HLREAL shall not be held legally liable for any direct or indirect claims, demands, costs, charges, expenses, losses, damages and compensations arising out of or relating to such goods and/or services. 14. Transactions which are wholly settled by HK$50 Fashion Walk e-Dining Coupons do not entitle Members to register Registered Spending and hello Points and redeem Benefits, including but not limited to parking promotions / privileges (for a transaction settled partially by HK$50 Fashion Walk e-Dining Coupons, the portion of such transaction not settled by HK$50 Fashion Walk e-Dining Coupons and which satisfy the requirements under the hello Program T&C will be accepted). 15. Use of the HK$50 Fashion Walk e-Dining Coupons may be subject to, apart from these Terms and Conditions, other terms and conditions prescribed by HLREAL and/or the e-Dining Coupon Participating Merchants from time to time. For details, please refer to such terms and conditions (if any). 16. HK$50 Fashion Walk e-Dining Coupons cannot be used for the following transactions: (i) the purchase or topping-up of Octopus cards and other “stored value facilities” as defined under the Payment Systems and Stored Value Facilities Ordinance (Cap. 584 of the Laws of Hong Kong); (ii) bill payments (including but not limited to payments to utility companies, the Government, statutory organizations, educational institutions, banks and credit card companies); (iii) the payment of telecommunication fees or the purchase of phone cards; (iv) the purchase of (electronic or otherwise and whether or not issued by HLREAL and/or its associated companies) shopping vouchers, gift vouchers, any other types of vouchers, cash coupons, tokens, gift cards, gift certificates, membership cards, bonus point cards, discount cards, value-added cards, shoe coupons, soup coupons, drink coupons, food coupons, any other types of coupons, cake cards (including Chinese bridal cake cards) and wedding coupons / vouchers; (v) the purchase of tickets (e.g. show / event / concert / exhibition tickets); (vi) the purchase of stamps; (vii) the purchase of gold grains, bars and deposits at gold saving clubs and the like; and (viii) any other transactions determined by HLREAL from time to time at its sole and absolute discretion. 17. To use a HK$50 Fashion Walk e-Dining Coupon, Members must present the HK$50 Fashion Walk e-Dining Coupon to the e-Dining Coupon Participating Merchant before checkout. Members should follow the following procedure: (i) inform staff at the e-Dining Coupon Participating Merchant that the transaction will be settled by a HK$50 Fashion Walk e-Dining Coupon; (ii) log into the “Account” section of the Hang Lung Malls App; (iii) click the “My Wallet” section then select the HK$50 Fashion Walk e-Dining Coupon and the quantity thereof to be used; (iv) present the Member’s mobile phone or device to staff at the e-Dining Coupon Participating Merchant, who will (among others) input a 5-digit passcode; and (v) after successfully inputting the passcode, the relevant HK$50 Fashion Walk e-Dining Coupon will be shown as redeemed in the “My Wallet” section and the transaction record will be shown in the Hang Lung Malls App. 18. A photograph or screenshot of any HK$50 Fashion Walk e-Dining Coupon will not be acceptable. 19. HLREAL may at its sole and absolute discretion and at any time amend these Terms and Conditions or any aspect of the HK$50 Fashion Walk e-Dining Coupons and/or withdraw or terminate the HK$50 Fashion Walk e-Dining Coupons without prior notice. In case of any dispute, HLREAL reserves the absolute right to make the final decision and the decision of HLREAL shall be final and conclusive. HLREAL accepts no liability for any such amendment, withdrawal and/or termination. 20. By using the HK$50 Fashion Walk e-Dining Coupons, Members are deemed to have read, accepted and agreed to comply with these Terms and Conditions and accepted that HLREAL is entitled to the rights set out in such Terms and Conditions. In case of any breach of these Terms and Conditions, or any dishonest or fraudulent conduct and/or acts by a Member, HLREAL has the sole and absolute discretion to immediately revoke the Member’s entitlement to any benefits, demand and recover from any Member the benefits redeemed or equivalent value in cash and pursue any legal action, without any prior notice. 21. Due to unforeseen circumstances, force majeure events and/or circumstances not under the control of HLREAL, including, without limitation, acts of God, earthquakes, fires, floods, wars, civil or military disturbances, acts of terrorism, sabotage, strikes, epidemics, riots, power failures and computer failure, HLREAL may at its sole and absolute discretion and at any time amend these Terms and Conditions or any aspect of the HK$50 Fashion Walk e-Dining Coupons and/or withdraw or terminate the HK$50 Fashion Walk e-Dining Coupons without prior notice. HLREAL accepts no liability for the aforementioned amendments, withdrawal and/or termination. Under such circumstances, in case of any dispute arising out of the HK$50 Fashion Walk e-Dining Coupons or these Terms and Conditions, HLREAL reserves the absolute right to make the final decision and the decision of HLREAL shall be final and conclusive. 22. In case of any dispute arising out of the HK$50 Fashion Walk e-Dining Coupons or these Terms and Conditions, HLREAL reserves the absolute right to make the final decision and the decision of HLREAL shall be final and conclusive. 23. In case of discrepancies or inconsistencies between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.
